Please read the following Declaration of liability carefully. With your Signature you confirm (hereinafter also referred to as "participant") that you have taken note of the following liability statement and the General Terms and Conditions (GTC) of SEPORSURF. The aforementioned GTC have already been made available during the booking process and can be viewed online at any time on www.seporsurf.ch or directly on site at the surf session.

The safety rules and regulations are binding for all participantsparticipation in the briefing preceding the surf session is mandatory .. The instructions of the staff (including the surf coaches) must always be followed.. The use of SEPORSURF's systems is always at the participant's own risk and responsibility..

 
  1. Participation requirements/ (special) risks

Participation requirements/ (special) risks Participation is generally reserved for persons who have reached the age of 18. The booking/participation of minors requires a written declaration of consent of the legal guardian(s) or their presence during the surf session.

Outdoor and freestyle events inevitably involve certain risks.Participation in the surf sessions requires in any case a very good general state of health and good fitness. A certain increased risk of injury is generally to be expected during the surf sessions. The participant is basically responsible for correctly assessing his/her own fitness before and during participation in the surf session and, if necessary, to inform the surf coach immediately of any (health or other) limitations, pain, problems or the like. This applies to both known and spontaneously occurring circumstances.

Participation in a surf session under the influence of drugs or alcohol as well as under the influence of psychotropic drugs is excluded.Participation is also excluded if the participant suffers from high blood pressure, cardiovascular risks, heart problems or epilepsy, is pregnant or has undergone eye surgery prior to participation.

When getting on and off the SEPORSURF system and the surfboard, the participant must exercise particular caution as slippery stones and varying current conditions may cause the system to move away, resulting in an increased risk of injury.

  1. Abort

For reasons of safety, also of the other participants in a surf session, it must be expressly reserved that the surf coaches on site, according to their own professional judgement, may, if necessary, carry out a cancelation of the surf session or individual participants (e.g. in the event of problems, safety risks, insufficient personal equipment, etc.) refuse further participation. Surf sessions can be cancelled or changed by the organiser even after the start if weather conditions, currents, the danger of increased flotsam, official measures or requirements, force majeure, safety reasons or other reasons make this necessary.

  1. Rescue measures

If third parties have to be called in to support the participant (e.g. rescue services), the Expenses incurred are to be payed by the participant (the participant's accident insurance) or the organiser or the organiser has the right to collect any costs incurred from the participant.

  1. Liability

The organiser (as well as its organs, employees, representatives, agents or vicarious agents) shall not be liable for a specific success or a specific result, which the participant may hope for or expect from the surf session. It is expressly pointed out that the results and effects of the same course offer may well vary for different participants due to factors that cannot be controlled (such as physical condition, state of health, fitness).

The organiser (as well as its organs, employees, representatives, agents or vicarious agents) shall only be liable to the participant for damage to property in the event of gross negligence or intent - irrespective of the legal grounds; liability for personal injury due to fault is not limited. The organiser (as well as its organs, employees, representatives, agents or vicarious agents) shall not be liable to the participant for lost property, damage to clothing, material or the like in the course of surf sessions.

  1. Group events

If the participant is the organiser of a group event, he/she shall explicitly bring the General Terms and Conditions of the organiser to the attention of each member of the group. In particular, the participant as organiser of the group event assures that the group members fulfil the necessary health and physical requirements.
